Bug in API Command IJ.openImage(path)?

Hello,

I executed the above command to open a  16 Bit B/W Image also containing an overlay (ij.jar vers. 1.52p). The Image pops up but the overlay is not displayed, whereas comand

new ImagePlus(path).show() did it properly.
